Wisconsin Department of Justice Obtains Judgment Against Portage County Property Owners for Erosion Control Violations

The defendants have agreed to pay $5,000 in forfeitures, penalties and attorney fees.

MADISON – December 4, 2012 – (RealEstateRama) — Attorney General J.B. Van Hollen has announced that his office has obtained a judgment in a civil action filed in Portage County Circuit Court on April 2, 2010, against Lexton Properties, LLC and HH Condos, LLC of Stevens Point, Wisconsin. The civil complaint filed by Assistant Attorney General Cynthia Hirsch alleges that the defendants owned properties in Portage County known as Harmony Village, North Harmony Village, and Echo Dells and at various times, as managers of these properties, the defendants failed to implement and maintain erosion control practices on the referenced properties in violation of Wisconsin law.

Erosion control is mandated by Wisconsin law and important to protect Wisconsin’s lakes, rivers, and streams from harmful pollution. The defendants have agreed to pay $5,000 in forfeitures, penalties and attorney fees. All environmental problems have been corrected.

Judge John V. Finn of Portage County Circuit Court signed the Order for Judgment and Judgment on November 29, 2012.
